Terms of Service

1. The Service

Flagmosphere ("the Service", "we", "us") is a community platform at flagmosphere.com that allows users to create pixel-art flags, vote on submissions, comment, discuss in the community forum, enter contests, earn and spend Flagcoin, and appear on a leaderboard. The Service is provided on an "as is" basis.

2. Eligibility

You must be at least 13 years old to create an account. By registering, you confirm that you meet this requirement. Where the law of your country sets a higher age for valid consent to online services (for example, up to 16 in some EU countries), you must meet that age or have parental or guardian consent.

You may only create one account. Registering multiple accounts to circumvent bans or vote manipulation rules is prohibited.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide an accurate, working email address at registration.
• Keep your password secure and not share it with others.
• Notify us immediately at info@flagmosphere.com if you believe your account has been compromised.

If you register but do not verify your email address, we will send a reminder after 7 days and, if the account is still unverified 30 days after registration, delete it. You can verify at any time using the link in the reminder email.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice where necessary to protect the community.

4. User Content

4.1 Ownership

You retain full ownership of the flag designs and other content you create and submit to Flagmosphere ("Your Content").

4.2 Licence grant

By submitting Your Content, you grant Flagmosphere a worldwide, non-exclusive, royalty-free licence to store, display, reproduce, and distribute it on and through the Service — including social-preview images, share links, and embeddable views of your flag displayed on other websites — for as long as it remains on the platform. This licence does not affect your ownership or your right to use Your Content elsewhere.

4.3 Public visibility and embedding

Flag designs and user profiles are publicly visible and may be indexed by search engines. Comments on flag pages are public. The community forum is visible to registered users. Do not submit content you wish to keep private.

Every public flag can be embedded on other websites through the embeddable view we provide. Embeds are served from Flagmosphere, remain subject to these Terms, and stop working when the flag is deleted. You may embed public flags elsewhere as long as the attribution stays intact and you do not imply an endorsement that does not exist.

4.4 Content rules

You agree not to submit content that:

• Is sexually explicit, pornographic, or obscene.
• Promotes, glorifies, or incites hatred, violence, or discrimination against any person or group based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other characteristic.
• Depicts or promotes illegal activity.
• Infringes the intellectual property rights of any third party.
• Constitutes spam, unsolicited advertising, or repetitive low-effort submissions.
• Contains or facilitates malicious code, links, or social engineering.
• Is intentionally misleading, false, or designed to harass another user.

Content that violates these rules may be removed without notice. Serious or repeated violations will result in account suspension or permanent ban.

4.5 Content after account deletion

If you delete your account, your flag designs remain on the platform, but the author is replaced with "deleted user" so they are no longer attributed to you. Forum posts and replies are anonymised — the content remains visible but is no longer linked to your username. Comments, votes, reports, reactions, favourites, notifications, and in-app messages are deleted. If you wish to have specific flags or forum posts removed, please delete them before deleting your account, or contact us after deletion.

5. Prohibited Conduct

In addition to the content rules above, you agree not to:

• Attempt to manipulate voting — including through the use of multiple accounts, bots, or coordinated inauthentic behaviour.
• Harass, threaten, or intimidate other users.
• Attempt to gain unauthorised access to any part of the Service, its servers, or another user's account.
• Reverse-engineer, scrape, or systematically download content from the Service without our written permission.
• Circumvent, disable, or interfere with security features of the Service.
• Use the Service in any way that could damage, disable, or impair its operation or availability.

6. Moderation and Enforcement

Flagmosphere is moderated by volunteer moderators and administrators. Moderators may hide or remove flags that violate these Terms. Administrators may ban accounts.

Moderation decisions are made at our discretion. If you believe a decision was made in error, you may contact us at info@flagmosphere.com to request a review. We are not obliged to restore removed content or reinstate banned accounts.

7. Flagcoin

Flagcoin is a virtual, in-game currency with no monetary value. It cannot be purchased, sold, exchanged for cash or anything of value, or transferred between accounts. You earn Flagcoin through activities such as contests, and you may spend it on features such as changing your username.

We may adjust, reset, or remove Flagcoin balances, prices, and earning mechanics at any time. Flagcoin is forfeited when your account is deleted or terminated, and we are not liable for any loss of Flagcoin.

8. Contests

We may run contests at announced times around a given theme. Entries are flags submitted during the contest window, and winners are determined by community votes (net score) as displayed, or as otherwise described for a particular contest.

Prizes are awarded in Flagcoin and have no cash value. We may disqualify entries that breach these Terms, manipulate voting, or are otherwise invalid, and our decisions (including on winners) are final. We may modify, suspend, or cancel a contest where necessary.

9. Intellectual Property

The Flagmosphere name, logo, platform design, and software code are the intellectual property of Flagmosphere and are protected by applicable laws. You may not reproduce, distribute, or create derivative works from them without our express written permission.

Flag designs that are derivative of real-world flags may be subject to the intellectual property laws or sovereign rights of the relevant country or organisation. You are responsible for ensuring your submissions do not infringe third-party rights.

10. Copyright Complaints

If you believe content on the Service infringes your copyright, please email info@flagmosphere.com with: (a) identification of the copyrighted work; (b) the URL or location of the allegedly infringing content; (c) your name and contact details; (d) a statement that you have a good-faith belief the use is not authorised; and (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act on their behalf. We will review and remove infringing content where appropriate.

11. Indemnification

You agree to indemnify and hold harmless Flagmosphere and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your breach of these Terms or of any law or third-party right.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you agree to the collection and use of information as described therein.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or discontinue the Service at any time without notice or liability.

User-generated content on the platform does not represent our views. We are not responsible for content posted by users.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Flagmosphere and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Service — including loss of data, loss of profits, or damage to goodwill — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) €10. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Changes to These Terms

We may revise these Terms at any time. We will indicate the date of the most recent revision at the top of this page, and where appropriate we will notify registered users by email of material changes. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you should stop using the Service and may delete your account.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. We may assign our rights and obligations; you may not assign yours without our consent. Our failure to enforce a provision is not a waiver of it. Provisions that by their nature should survive termination (including ownership, indemnity, disclaimers, and limitation of liability) will survive.
